2. Description of Services

Barstow Deck & Fence provides residential deck construction, fence installation, outdoor structure installation, and related services in the Barstow, CA area and surrounding communities. Services are performed by licensed contractors and may include design consultation, permitting assistance, material procurement, labor, and project management.

All services are subject to a signed written agreement between Barstow Deck & Fence and the customer prior to commencement of work. Nothing on this website constitutes a binding offer or contract for services.

3. Estimates and Pricing

Estimates provided by Barstow Deck & Fence - whether by phone, email, or in person - are based on the information available at the time of the estimate. All estimates are subject to change if the scope of work, site conditions, or material costs change before or during the project.

A written estimate is not a binding contract. A project begins only when both parties sign a written contract specifying the scope of work, price, payment schedule, and timeline. Any changes to an approved scope of work must be agreed to in writing as a change order before additional work is performed.

Permit fees, utility location costs, and other government or third-party fees are not included in a base estimate unless specifically stated in writing.

4. Scheduling and Cancellation

Project start dates are estimates and may be affected by permit review timelines, weather, material availability, or other factors outside our control. We will notify you of any material change to the scheduled start date as soon as possible.

If you need to postpone or cancel a scheduled project, please notify us in writing as early as possible. Cancellation terms, including any deposit refund conditions, will be stated in the signed project contract. In general, deposits paid for work not yet begun may be partially or fully refundable depending on costs already incurred.

We reserve the right to reschedule or decline a project at any time before a contract is signed, without obligation.

5. Payment Terms

Payment schedules will be specified in the signed project contract. Payment is typically structured as a deposit before work begins, with additional installments tied to project milestones, and a final payment upon substantial completion.

Accepted payment methods will be confirmed at the time of contract signing. Invoices not paid within the timeframe stated in the contract may accrue late fees as specified therein.

Barstow Deck & Fence reserves the right to suspend work if payments are not made according to the agreed schedule. Any costs incurred as a result of a payment dispute or collection action will be the responsibility of the non-paying party.

6. Warranties and Warranty Disclaimers

Barstow Deck & Fence provides a workmanship warranty on completed projects as specified in the signed contract. This warranty covers defects arising from our installation work under normal use conditions.

Material warranties are provided by the manufacturers of the materials used and are passed through to you to the extent permitted. We make no additional representations regarding manufacturer warranties.

Warranties do not cover damage caused by misuse, unauthorized modifications, acts of nature, normal wear, or failure to perform recommended maintenance. The workmanship warranty is void if the project is altered by anyone other than Barstow Deck & Fence without prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Barstow Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this website or from services provided, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from services rendered shall not exceed the total amount paid by you for the specific project giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

8. Use of This Website

You may use barstowdeckandfence.com for lawful purposes only. You agree not to use this site to submit false or misleading information, to interfere with its operation, or to attempt to access systems or data you are not authorized to access.

All content on this site - including text, images, and design - is the property of Barstow Deck & Fence or its licensors. You may not reproduce, distribute, or use this content for commercial purposes without written permission.

9. Dispute Resolution

If a dispute arises between you and Barstow Deck & Fence regarding services or these terms, both parties agree to first attempt to resolve the matter informally by contacting us directly at quotes@barstowdeckandfence.com.

If informal resolution is not possible, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, or in the courts of San Bernardino County, California. Each party waives the right to a jury trial and to participation in a class action or class-wide arbitration.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms or our services shall be brought in a court of competent jurisdiction in San Bernardino County, California.

11. Modifications to These Terms

We may revise these terms at any time by updating this page. Changes take effect on the effective date shown at the top of this document. Your continued use of this website or our services after the effective date constitutes your acceptance of the revised terms.
